Constitute Seven Judges' Bench to decide the issue regarding the pending collegium recommendation: Justice Kurian Joseph writes to CJI

Again the battle between judiciary and Government has been sparkled in view of the letter written by Justice Kurian Joseph, a Supreme Court Judge, to the Chief Justice of India. It is learnt that Justice Kurian Joseph written a letter to CJI requesting to constitute a Bench consisting of seven senior most Judges of Supreme Court of India to consider the undue delay on the part of the Government in deciding about the recommendation of the Collegium of Supreme Court of India in recommending KM Joseph and Indu Malhotra for appointment in the Apex Court. The aforesaid proposal has been kept pending before the Central Government without any progress. Justice Kurian Joseph expressed that it is the duty of the Central Government to decide about the collegium recommendation either one way or other. The Supreme Court should not be in dark as to what happens to its recommendation. He further expressed that such undue delay will send a signal to the Judicial Officers that if something done against the Government, they will be affected at one point of time. Such signal will spoil the independence of judiciary. The request of Justice Kurian Joseph is nothing but a strong slap against the government. Will wail and watch for CJI’s decision on his letter.
