May you be howsoever high, the law is above you- Senior Advocate Dushyant Dave argued in the PIL filed by Mr.Shanthi Bhushan

Mr.Shanthi Bhushan filed PIL for regulating the powers of CJI in allotting cases to the Benches and for a direction to declare that Chief Justice of India means collegium of five senior most Judges of Supreme Court. In other words, he challenged the powers of CJI as Master of Roaster in the administrative side. The above matter came up before Justices Ak Sikri and Ashok Bhushan and they raised various questions and also requested to suggest alternative methods to solve the issue. The Supreme Court expressed its view that the Collegium will not assemble everyday and decide about the allocation of cases. However, it sought the assistance of Attorney General KK Venugopal and ASG Tushar Mehta in this issue. The matter has been adjourned to 27th of April.

It is needless to mention that only few days before the Supreme Court has reaffirmed that the Chief Justice is the Master of Roaster and his position cannot be presumed to be doubted. Will see what the Supreme Court says in the PIL filed by Shanthi Bhushan. Mr.Kapil Sibal also appeared on behalf of the Mr.Shanthi Bhushan.
