The Order of the Vice President as a Chairman of Rajya Sabha in rejecting the impeachment motion at the admission stage has been challenged before the Apex Court. An embarrassing and difficult decision be placed before the Supreme Court in placing the above case before whom and who has to constitute the Bench. All are questions, which are difficult to answer.
Mr.PARTAP SINGH BAJWA, Member of Parliament from Punjab, Rajya Sabha and DR. (MRS.) AMEE HARSHADRAY YAJNIK, Member of Parliament from Gujarat, Rajya Sabha, who are signatories to the impeachment motion has filed the aforesaid Writ Petition challenging the impugned order of Rejection.
The Rejection has been challenged on extensive grounds. The main attack is that the Chairman of Rajya Sabha has no authority to decide the validity of the allegations of proved misbehaviour and the authority only vests with the Committed so appointed by the Parliament. So, the Chairman has clearly violated the provisions of Constitution and hence the impugned order is illegal.
