The Legislators, who are practicing Lawyers, prohibited from practicing before the Court of a Judge, against whom they initiated impeachment proceedings.

The Bar Council of India has announced that the Lawyers, who are Members of Parliament or any Legislative Assembly, are restrained from practicing before the Court of a Judge, against whom they initiated impeachment proceedings. The decision has been taken by the General Body of BCI on 18th March, 2018. The announcement has been made when a strong proposal for initiation of impeachment against the sitting Chief Justice of India is under process by the Congress Party. It is also to be noted that a litigation is pending before the Supreme Court of India as to whether the Legislators can be permitted to practice before the Courts of Law or not? The BCI has expressed its intention that prohibiting the Legislators from practicing before the Court of Law already approved by BCI and the decision has not been set aside by the Supreme Court. So, the decision stands valid as on today.
