One of the CBSE students has challenged the decision of CBSE in cancelling the earlier Mathematics Examination for X std and conduct of re-examination before the Supreme Court of India. The Writ petition has been filed by one Rohan Mathew
, a Class X student of Choice School, Tripunithara. The petitioner alleged that “The decision of CBSE in cancelling the examination and ordering a reexamination is highly disproportionate to the alleged incident. It is respectfully submitted that the it appears that CBSE has cancelled the examination as the first resort, instead of it being the last resort.”
The Petitioner has also relied upon a decision reported in 2015- 6- SCC 573 in order to sustain his view. Only upon extreme circumstances and upon a sufficient evidences, Re-exam can be conducted. But in the case on hand, mere apprehension that the question paper is out before the Exam, CBSE cancelled the examination. CBSE took a decision without any initial probe and without considering the fact the alleged leak also only in certain areas. The matter is likely to be listed next week.
Similarly, another public interest litigation has been filed by Mr.Kansal, who is a practicing Lawyer, challenging the holding of re-exam of Economics of XII standard. He also raised similar grounds.
